I know. they suck. why do they do it? cos they suck! this one has the nerve to not only use other people's art and take all the credit but include a 'do not use' warning in their description! SO BACKWARD! they've blocked me of course cos its scarey getting caught by one of the artists they've abused.
They copied my oriental lantern and when confronted deleted it and blocked me but that's not gonna make me go away when other artist's works are being stolen.fbcdn-sphotos-c-a.akamaihd.net…

I have to side with Cocoaprints on this one... I hate thieves as much as anyone, and it's obvious that the concept is widely used... every tattooer I know has drawn or painted something similar to these at least once, it is an iconic concept...The rule of thumb for copyright infringement is around 15% in a given case... and there is much more than a 15% difference in these pieces...Short of a photocopy, or file theft, You almost have to trace it in exact detail, including shading and/or color for it to be considered theft, and it looks to me as if there were any tracing done at all, it was for proportion... the anchor is in a different spot, the kraken itself is drawn in a different style, and the detail in the ship differs as well... I can't call this theft.

I'm not sure I can qualify this as "art theft"....

Sure, images similar with similar design/concept/idea, but does that really qualify it as theft? How often do we use reference pictures? How often do we get inspired to draw something based off of something we've seen, either in our life or a picture we find online?

This is not something new. If that was the case, then every art student in the world should be tried for "copying" a similar idea from the pictures posted around their classroom or something assigned by their teacher.

For this particular instance: Kraken attacking a ship. One of the least unoriginal ideas ever. And if this is going to be classified as art theft, then everyone who has drawn an image of the kraken attacking a ship should be considered a thief for taking from the original mosaic of the idea a thousand years ago!

The first one i totally agree with the silhouette is the same, as for the boat and octopus not really the boats facing a different way the the octopus is holding the boat differently and the style are different, maybe the concept but how many boats with octopi' or squid have people done in the past xx

no i mean the pirate ship one is totally different  nothing really the same apart from there is an octopus and a ship
